Luis María Peña fue conocido en los años noventa como uno de los “Intocables” de la DGI. Era la cara más conocida del equipo de funcionarios de la agencia recaudadora. Se hizo famoso por comandar resonantes operativos dirigidos a perseguir a los grandes evasores fiscales.
Teniendo en cuenta su vasta experiencia en relación a los delitos impositivos, ¿qué opinión le merece la liberación de Cristóbal López?
-Se me ha producido un gran incendio. Se me quemaron todos los textos de los maestros del derecho tributario, se me quemaron los años de estudio y ejercicio en la docencia, pero fundamentalmente, se me quemó la Justicia argentina.
Una cosa es evadir; otra cosa muy distinta es ser agente de retención, quedarse con el dinero del Estado e invertirlo en lo que se le ocurra. Es vergonzoso que una persona diga que la malversación que hizo Cristóbal López es lo mismo que evadir, es inconcebible. Este señor se quedó con lo ajeno, no cumplió con la función de agente de retención.
Utilizó el dinero del estado como quiso, y eso es defraudación al fisco, como lo dicen los otros camaristas, pero bueno… a alguien se le ocurrió emitir este fallo que es una vergüenza para la justicia argentina.
-¿Y por qué cree usted que la justicia pueda emitir un fallo semejante?
-No, la justicia no, dos jueces. Le voy a ser totalmente honesto y decir lo que creo. Dos integrantes del Poder Judicial, Jorge Ballestero y Eduardo Farah, renegaron a dos de los principales principios que deben tener como integrantes de la justicia, que son la decencia y la moral, y esto es tremendo.
En pocas palabras, estos señores quieren justificar su fallo argumentando que «no hubo delito porque la plata no estaba en poder del Estado». Eso es un insulto al sentido común, porque la plata es del estado, ya que López es agente de retención. ¿Se entiende, entonces, porque digo que renegaron a los principios de decencia y moral?
-¿Cuál es su opinión sobre el actual sistema impositivo y que cosas modificaría?
-En primer lugar creo que nuestro sistema impositivo es distorsivo, y por lo tanto es regresivo. Fíjese que la pequeña actividad, como la de artesanos, comerciantes, pymes y profesionales se sigue gravando, y para bajar la presión fiscal a los que menos tienen, hay que tener el coraje de hacer como se hace en algunos países de gravar como corresponde a los más ricos.
Por citarle un claro ejemplo: Un banco o una multinacional pagan, proporcionalmente, lo mismo de Ganancias que alguien que tiene un taller, el conductor de una locomotora o un empleado público.
Por otro lado, aquí se cobran impuestos al trabajo, cuando el trabajo es una compensación por el esfuerzo, y no tiene ningún tipo de amortización, como sería una empresa.
-Durante el año pasado se habló mucho, especialmente desde el gobierno, sobre una reforma impositiva integral. ¿Según usted, qué se debería modificar?
-En primer lugar se debe eliminar la regresividad, que se hace de dos maneras. Empezando a eliminar los impuestos al trabajo. No puede pagar la misma alícuota de ganancias un gerente de una empresa multinacional que un empleado que gana veinte o veinticinco mil pesos por mes.
Lo segundo es terminar con los privilegios. Son privilegiados, por ejemplo, los bancos, las empresas aseguradoras, las financieras…
Otro impuesto distorsivo es Ingresos Brutos, que además tiene el efecto cascada. Sobre un mismo producto, paga impuesto el fabricante, el distribuidor, el transportista, el vendedor minorista, etc… En fin, tenemos impuestos de todo tipo y color, desde el impuesto al cheque hasta una infinidad de impuestos provinciales; pero realizar una reforma impositiva integral es algo muy complejo que no se puede hacer así nomás.
-Convengamos que también, la alta cantidad de impuestos tientan al contribuyente a la evasión.
-¡Totalmente! Mire, volvemos al principio… si el gravamen al combustible, por ejemplo, no sería tan alto, no creo que se hubiese producido la estafa que hizo Cristóbal López.
